Warranty conditions

Thank you for your interest in the products Gruppo Energia.

This product is offered to you conditioned upon your acceptance without modification of the terms, conditions, and notices contained.

This warranty applies only to physical goods purchased from Gruppo Energia.

What does the warranty cover?

All of Gruppo Energia products are made to meet or exceed industry standards. We offer 100% guarantee exclusively against manufacturing defects caused by improper workmanship or defective material. This guarantee is valid for replacement of the product for up to 12 months from the date of shipment (date when goods leaves the factory of manufacturer) which is shown in the shipping documents.

Gruppo Energia will bear the costs and expenses of the replacement of the product, if its responsibility has been previously demonstrated and established. In case of necessary replacement under warranty, the new guarantee period shall be given to replaced product. Gruppo Energia shall bear the shipping costs of the products for replacement from the factory to the Distributor. Any different and further responsibility is excluded for damages occurring to the buyer or third parties for as much as regards using the Manufacturer’s products. The warranty is effective exclusively towards Gruppo Energia’s direct buyer. Damages claimed by third parties will be turned down.

Gruppo Energia warrants the replacement value of Gruppo Energia products only. Gruppo Energia liability will not exceed the value of Gruppo Energia materials involved. Gruppo Energia is not responsible for any consequential damages.

Gruppo Energia is not liable for any damages beyond the value of the capacitors or other Gruppo Energia products.

What does the warranty not cover?

Due to potential misapplication of reverse voltage and improper handling or storage outside of our control, failure of any brand is possible with no implication of responsibility to the capacitors, their manufacturer or supply chain.

Therefore this warranty shall not apply to the products chosen without consideration of the working conditions on a place of installation. Improper choice and/or usage of the products excludes any responsibility of the manufacturer and the warranty. This warranty shall not apply or include to any repair or replacement required as a result of accident, misuse or neglect, improper treatment, overloading, circuit errors, repairs not performed in accordance with the Products Manuals, replacement of parts not installed in accordance with the Products Manuals, modifications not recommended or not approved in accordance with the Products Manuals, normal wear, tear and deterioration, erosion or corrosion, any damage to any Product(s) caused by improper storage during the period of time when the Product(s) are under control of Distributor and/or its customers. Warranty is also excluded in cases where faults can no longer be recognized in the products owing to third part interference. Gruppo Energia has the right to inspect any records proving the use of its products.

Gruppo Energia warrants the quality of Gruppo Energia products only. The application and processing of Gruppo Energia products is beyond our control and therefore is the sole responsibility of the user and/or the dealer. Due to varying procedures and conditions, Gruppo Energia’s written or verbal instructions are based on experience with our products and we strongly recommend thorough inspection and testing of the product prior actual use.

After receiving the goods, the Distributor/Gruppo Energia’s Direct Customer must make visual checking of all the products, making sure that no any accident occurred during the shipment and that the goods are in good condition. Any potential defects occurred during shipment and founded during the visual control must be promptly notified in writing within 20 days from the date of receiving the goods (shown on the shipping documents). In the event that the Distributor/Gruppo Energia’s Direct Customer finds defects in the Products, the Distributor/Gruppo Energia’s Direct Customer shall be responsible for reporting the circumstances in writing to Manufacturer within the warranty period herein above stated.

In the event of a defective product claim, Gruppo Energia requires that samples showing the defect be submitted for inspection and testing to verify the alleged claim. These samples shall be submitted to Gruppo Energia at user’s or distributor’s expenses.

The responsibility between Manufacturer and Distributor/Direct Customer for the goods during the shipment will be regulated in correspondence with INCOTERMS rules in effect at this time.

Except as otherwise expressly provided in this agreement, neither party makes any representation or extends any warranty of any kind, either express or implied, to the other party with respect to any technology or other subject matter of this agreement and hereby disclaims all implied warranties of merchantability, fitness for a particular purpose and non infringement with respect to any and all of the foregoing.
